Trade Agreements Investment Protection And Dispute Settlement In Latin America

Book by Belén Olmos Giupponi, Trade Agreements Investment Protection And Dispute Settlement In Latin America Books available in PDF, EPUB, Mobi Format. Download Trade Agreements Investment Protection And Dispute Settlement In Latin America books, In recent years many Latin American countries have liberalized their trade and investment regimes, opening their markets to free international trade. At the same time, regional economic integration has boomed. This book is the first systematic analysis in any language of these globally significant developments, and the first comprehensive legal study of dispute settlement relating to foreign direct investment and trade in the region. Undertaken by an expert in the field, this study describes the current institutional framework of Latin American trade and investment law as well as specialized legal issues in the region's various economic blocs. Among the many issues and topics raised the following may be mentioned: • questions of compliance and procedure in the context of today's international investment regime; • formalized dispute settlement mechanisms; • alternative dispute resolution channels, including dispute prevention practices; • legitimacy and transparency of the various dispute settlement mechanisms; • inclusion of social clauses in trade and investment agreements; and • avoidance of investment treaty liability. In order to offer a most accurate view of the effectiveness of the protection granted to foreign investors, special attention is given to relevant case law – completely covering the period 1985–2015 – as well as arbitral precedents before international bodies and in jurisdictions across the region. The book concludes with a critical examination of the future prospects of international economic law dispute settlement in the Americas, pinpointing current trends and unveiling future possible avenues for change. As an in-depth explication of how the rules and principles of international economic law are applied in Latin America, this book has no peers. For practitioners drafting business agreements with Latin American companies, or needing to ensure availability of appropriate remedies, this book's detailed insight into international litigation in the region, including case law illustrating the main topics, will prove to be of immeasurable value. Professionals in the arbitral community worldwide, as well as governments, dedicated research centres and officials in international organizations will welcome this book's model for comparative integration studies, systematic guidance on procedure and case law of domestic and international courts and arbitral tribunals, and extensive treatment of dispute settlement mechanisms in trade and investment agreements.

Foreign Direct Investment In Latin America And The Caribbean 2019

Book by United Nations, Foreign Direct Investment In Latin America And The Caribbean 2019 Books available in PDF, EPUB, Mobi Format. Download Foreign Direct Investment In Latin America And The Caribbean 2019 books, This ECLAC annual report sets out and analyses the main foreign direct investment (FDI) trends in the countries of Latin America and the Caribbean. In the region, FDI inflows were up (by 13.2%) year on year for the first time in five years, at US$ 184.287 billion. This performance is explained by higher flows into just a few countries, however, mainly Brazil and Mexico. Moreover, it does not reflect equity investment, but higher inflows in the form of intercompany loans and, to a lesser extent, reinvestment of earnings. Manufactures and services were the sectors receiving most equity, although there was a slight rise in investment in natural resource sectors compared with 2018.

Foreign Direct Investment

Book by Dale R. Weigel, Foreign Direct Investment Books available in PDF, EPUB, Mobi Format. Download Foreign Direct Investment books, The report reviews lessons from the International Finance Corporation's (IFC) investment, and advisory experience in the developing world, which show the interactions between policy frameworks, and the volume and structure of foreign direct investments (FDI). Case studies show how the Corporation promotes successful project structures, and regulatory changes, as it tries to attain the strongest development impact for investments. In developing countries, FDI has flowed mainly into manufacturing, and processing industries. In the past, investment attractiveness had been closely linked to possession of natural resources, or a large domestic market, while production and trade globalization, competitiveness as a location for investment, and exporting, have become the main determinants of attractiveness. Sources of FDI in the past, came almost exclusively from industrial countries, though recently those sources have widened, emerging from developing countries in their own right, and for their own regions. IFC, as an international initiative to promote FDI in developing countries, is liable to promote bilateral trade agreements, bilateral and multilateral financial institutions, and investment promotion programs; its advisory role may vary from diagnostic studies overviewing constraints to FDI, to investment policy studies giving specific solutions on either changes, or strategies. The study further looks at how policy environment is set, and at finding investor opportunities, through project financing, largely structured as joint ventures. The inherent, fragile nature of joint ventures, restricts foreign ownership, thus limiting project structures; however, careful project design has lead to successful operations, by ensuring management, and financial arrangements. Still, to maximize benefits, an unfinished agenda of policy reform remains, and, as more countries open to FDI, this integration will lead to an overall increase in FDI flows.

Foreign Policy Of The European Union Towards Latin American Southern Cone States 1980 2000

Book by Andrea Ribeiro Hoffmann, Foreign Policy Of The European Union Towards Latin American Southern Cone States 1980 2000 Books available in PDF, EPUB, Mobi Format. Download Foreign Policy Of The European Union Towards Latin American Southern Cone States 1980 2000 books, The study addresses the question of whether or not the EU's foreign policy towards Latin American Southern Cone States (Argentina, Brazil, Paraguay and Uruguay, which created, in 1991, the Southern Cone Common Market - MERCOSUR) has become more cooperative since the mid-to-end 1980s, and why a change, if any, has occurred. It explores recurrent explanatory factors pointed out in the literature (EU's intention to balance the US hegemony, accession of Portugal and Spain to the EU, and the processes of democratization, economic liberalization, and regional integration taking place in the Southern Cone States) in two case studies, foreign direct investment and agricultural trade. The conceptual framework includes hypotheses derived from three theoretical approaches in the discipline of International Relations: Neorealism, Utilitarian Liberalism, and Identity-Constructivism.
